Civil Sexual Abuse Lawsuits Against Dr. Amir Sitafalwalla
Dr. Amir Sitafalwalla, a doctor who most recently worked at ModernMD Urgent Care in Woodhaven, Queens, faces some serious criminal allegations. On September 9, 2024, authorities arrested and charged him for third-degree sexual abuse and forcible touching. The Queens District Attorney’s Office filed a criminal complaint.
This arrest happened not long after an event in January 2023, involving similar claims. Sitafalwalla was arrested in that case too but was released without bail.

According to a report from the Queens Chronicle, both incidents took place at ModernMD Urgent Care.
January 19, 2023
A male patient visited for a Covid test. He says Sitafalwalla asked him to unbuckle his pants, touched and spoke about the patient’s private areas, compared them to his own, and forcibly kissed him.
August 14, 2023
Another male patient states Sitafalwalla asked him to lower his pants. The doctor then supposedly touched the patient’s inner thigh and genitals and again made unsolicited comparisons to his own anatomy.
Sitafalwalla pleaded not guilty in both cases. He posted a $10,000 bail after the August 2023 arrest. The investigations are ongoing.

Civil vs. Criminal Sexual Abuse Cases
Criminal proceedings aim to punish offenders with jail time or registry as a sex offender. But civil lawsuits allow victims to:
Claim financial damages for medical bills, therapy, lost wages, and emotional distress
Seek punitive damages meant to punish and deter misconduct
Hold third parties accountable, such as clinics or hospitals, if they failed to prevent or respond to the abuse
Importantly, the burden of proof is lower in civil cases—survivors only need to show that it’s more likely than not (over 51%) that the abuse happened.
Types of Evidence in Civil Lawsuits
Evidence that can support a civil case includes:
Medical records
Text messages, emails, or communications
Eyewitness statements
Therapy and psychological reports
Testimony from expert witnesses
