Understanding Civil Sexual Abuse Lawsuits in NYC

Sexual abuse is not only a crime but also a civil violation, allowing survivors to seek financial compensation for emotional pain, therapy, medical expenses, and loss of quality of life.

The Difference Between Civil and Criminal Cases

  • Criminal trials require proof of guilt beyond a reasonable doubt.
  • Civil claims only require a preponderance of the evidence (just over 51%), making it possible for survivors to seek justice even if no criminal charges were filed.

Who Can Be Held Accountable?

  • The abuser
  • Employers or supervisors who ignored complaints
  • Hospitals or clinics that failed to act
  • Religious organizations, schools, or daycare centers
  • Landlords or property managers
  • Security companies or contractors

Extended Time to File Under NY Law

New York lawmakers have extended the statute of limitations to give survivors more time to come forward:

Victims of Gender-Motivated Violence Protection Law (VGMVPL)

Allows adult survivors in NYC to file civil lawsuits for gender-based violence until March 1, 2025, regardless of when the abuse occurred.

Adult Survivors Act (ASA)

Created a one-year “lookback window” for older abuse cases. While this window has closed, new adult claims still benefit from extended timeframes.

Child Victims Act (CVA)

Survivors of child sexual abuse can file claims until age 55—even against institutions that enabled the abuse.

Not sure if you still qualify? Our attorneys will confidentially review your case and discuss your legal options.

What Compensation Can You Pursue?

A civil sexual abuse lawsuit can provide financial compensation for:

Economic Damages

  • Mental health therapy
  • Medical treatments
  • Prescription medication
  • Lost income or job opportunities

Non-Economic Damages

  • Emotional distress
  • PTSD or trauma-related conditions
  • Pain and suffering
  • Loss of enjoyment of life

Punitive Damages

  • In particularly egregious cases, we may seek punitive damages—money awarded to punish the abuser and deter similar behavior.

Preserving Evidence & What to Do

If you’ve experienced sexual abuse:

  • Get to a safe space
  • Consider medical attention — A rape kit can serve as evidence
  • Write down everything you remember
  • Save messages, emails, or clothing
  • Reach out for legal help

You don’t have to report it to the police to pursue a civil claim—but doing so can help support your case.
